I-9 Responsibilities

The following table is a summary of I-9 responsibilities to be used by UC Davis department staff who are in charge of employment eligibility verification.  Please contact the appropriate SISS staff person if you have any questions.

IMMIGRATION STATUS EMPLOYMENT ELIGIBILITY REQUIRED DOCUMENTATION


F-1 students enrolled at UC Davis


No employment authorization needed, but with some restrictions.


I-20 form, I-94 card, and valid passport


F-1 students on Practical Training


Need employment authorization from USCIS (U.S. Citizenship and Immigration Services).


Employment Authorization Document (Form I-766)


H-1B temporary worker


Authorized to work.**


Form I-797 plus valid passport ***


J-1 students enrolled at UC Davis


No employment authorization needed.  Some may need a letter from their financial sponsor to work.


DS-2019 form issued by UCD, I-94 card, and valid passport


J-1 students on academic training


Need employment authorization by the visitor's sponsor.


DS-2019 form issued by UCD, letter from program sponsor authorizing work, I-94 card and valid passport


J-1 scholars


Authorized to work.  Work must be consistent with the terms, purpose and location stated on DS-2019.


DS-2019 form issued by UCD, I-94 card, and valid passport


J-2 dependent spouse


Need employment authorization by USCIS (U.S. Citizenship and Immigration Services).


Employment Authorization Document (Form I-766)


O-1 extraordinary ability


Authorized to work.


Form I-797 plus valid passport


Permanent Residents (green card)


Authorized to work.

 


Resident Alien Card (green card)


Applicants for permanent residence, refugee, or asylum status


Need employment authorization from USCIS (U.S. Citizenship and Immigration Services).


Employment Authorization Document (Form I-766)


TN Canadians and Mexicans under NAFTA


Authorized to work.


Valid I-94 card or I-797 notice

**Work authorization is employer specific.  Employees coming from another organization require the filing of a new H-1B petition.
***For change of employer cases only the receipt notice of the UCD H-1B petition is required.
